		<description>It&#039;s an interesting argument. Unfortunately, it is not one that would work with a judge. If the guy is going to continue to contact the woman against her expressed wishes, the judge would much rather issue the CPO and subject the guy to criminal contempt charges.  It would be embarrassing for the judge to deny the CPO only to have the guy go out the next week and assault the woman.</description>

		<description>I talked about this post last night with my girlfriend. She has an old friend from high school who texts her a few times a week with &quot;hey.&quot; Nothing more, it&#039;s always the same. She doesn&#039;t reply, but he keeps it up.
She told me she worries about his mental health. He&#039;s very overweight, awkward, etc. as well.
I imagine if someone was given a temporary restraining order and violated it, he very obviously &quot;doesn&#039;t get it.&quot; I don&#039;t know much about CPOs, but couldn&#039;t they defer to some sort of mental-health evaluation?
Otherwise, it seems like if he didn&#039;t get it the first time, isn&#039;t a CPO setting him up to fail?</description>

There was a case in front of mine yesterday in which Twitter was the major issue.  Fortunately, having recently joined Twitter, I could understand what the witnesses were talking about.  Neither the judge nor either of the two attorneys seemed to have a clue.  They kept confusing &quot;befriending&quot; from Facebook with &quot;following&quot; on Twitter.  And they didn&#039;t know if a message in the singular was &quot;twit&quot; or &quot;tweet.&quot;  

The issue was whether or not asking someone to follow you on Twitter was in violation of a Civil Protection Order. It was.  But the government could not prove that the Twitter request was done prior to the CPO being issued.</description>
